Section II - Concepts and terms used
Art. 2 (1) For these General Terms and Conditions, the following terms shall be interpreted and understood following the definition given to each.
1. A fortuitous event is an extraordinary circumstance unforeseen at the time of the contract's conclusion that results in the objective impossibility of performing the contractual obligations.
2. Cart - means a section of the site where the user or customer can view the selected and added products in a separate user session.
3. Comment - A customer review is a positive or critical statement shared by a buyer regarding their experience with a product they’ve purchased.
4. Commercial messages are sent through electronic communication channels (e-mail, SMS, notification, etc.) or by image. They contain text that contains general and thematic information on available promotions, discounts, and discounts for individual goods, as well as for entire categories or subcategories offered by the Merchant.
5. Contract - is the contract concluded remotely between the trader and the customer for the purchase and sale of goods through the online store owned by the trader; as an integral part of this contract are these Terms and Conditions;
6. Customer - shall be defined as any natural person at least 18 years of age, any legal entity represented by its representatives, or any other legal entity that is a party to at least one distance purchase contract.
7. Delivery time is when the customer receives the selected goods in the presence of the courier company. The delivery period depends on the customer's chosen delivery method and the specific forwarder. The usual delivery time is 1 to 5 working days. On weekends and holidays, the forwarder may unilaterally extend the period for which the Merchant cannot be held responsible.
8. Discounted Price - This is the price offered by the Merchant, which is lower than the usual selling price and is a reference for discounts. This discounted price is based on the lowest price the Merchant has advertised for the last 30 days before the introduction of the discount on the Goods in our online store;
9. Malicious actions or inaction include any actions or neglect that breach legal standards, violate online practices, or pose risks to others connected to the internet or related networks. Actions that harm or violate the rights of others online, break established standards, or create security risks are strictly prohibited. This includes sending unsolicited marketing messages, gaining access to secure areas without authorization, exploiting system vulnerabilities for personal gain, and engaging in spying or sabotage. It also covers distributing harmful software like viruses, taking control of devices without permission, and disrupting others’ online activities. Such behavior is strictly forbidden.
10. Merchant - this term refers to the legal entity that is party to the distance purchase agreement and owns the current online store, including the entity responsible for its development and maintenance;
11. Order - an electronic document representing a communication form sent by the Customer to the Merchant via the online store, through which the former expressly declares their desire to conclude a contract of purchase and sale, indicating the essential terms of the agreement, namely - the brand/model of the respective product, its quantity, specific characteristics (color, size, composition, etc.);
12. Password - a combination of letters, numbers, or symbols associated with a specific username, which the visitor uses to access their account;
13. Rating is a method of calculating a customer's satisfaction level concerning a product the latter has purchased. The rating is expressed in the form of stars, and each item may receive a rating of one to five stars. This degree of satisfaction may be accompanied by an additional comment explaining the rating provided.
14. Registered User - A registered user is at least 18 years old and legally capable of engaging in transactions. This can also include representatives of businesses who have set up an active profile in the online store. Registered users provide their personal information as the privacy policy outlines and are granted specific rights and responsibilities.
15. Review - A review is a written assessment provided by a customer who has purchased a product from the online store based on their experience and sharing feedback on whether the product meets the advertised specifications.
16. Selling price - The final price, including VAT and all other taxes and charges, that the customer must pay to acquire title to the specific goods.
Section III - Characteristics of the online store
Art. 3 (1) This online store enables users (from now on referred to as "Customers") to browse and purchase a variety of bags and accessories remotely. The primary functionalities provided by the Merchant through the online store include:
1. Viewing detailed descriptions, features, and images of bags and accessories to give comprehensive product information to Customers;
2. Accessing updated information on product availability, stock levels, and current prices to assist in informed purchasing decisions;
3. Placing order requests through the online store with the option for Customers to conclude purchase contracts for products remotely;
4. Facilitating secure online payment for ordered goods via debit or credit card, with provisions for other payment methods as may be offered by the Merchant;
5. Offering communication channels for Customers to connect with the Merchant regarding order inquiries, return policies, and terms applicable to the use of the online store;
6. Enabling account registration, allowing Customers to create personal profiles for faster checkout, order tracking, and easy access to order history;
7. Providing functionality for Customers to leave product reviews and ratings, enhancing transparency, and assisting other Customers in making informed choices;
8. Displayed up-to-date news, guides, and information on trends, care, and maintenance for bags and related accessories, ensuring customers remain informed on new offerings.
(2) These General Terms and Conditions govern the legal relationship between the Merchant and Customers, ensuring transparency and rights protection. Any deviation from these terms may occur only through a written agreement mutually agreed upon and signed by both parties, explicitly defining any limited applicability of these terms.
Art. 4 (1) Customers are entitled to enter into a remote purchase and sale contract for bags and accessories available on the online store. They can also order as guests (without requiring account registration).
(2) To initiate an order, Customers must complete the following steps:
1. Product Selection: Browse the selection of bags and accessories visible on the site, choosing one or more items by adding them to the shopping cart using the "Add to Cart" button.
2. Review and Confirmation: Review the cart's contents, including each product’s name, quantity, unit price, total amount, and any applicable shipping fees. Confirm the items by selecting the "Proceed to Checkout" button.
3. Provision of Delivery Information: Enter all necessary delivery details, including the recipient’s full name, delivery address (street, city, postal code), or designated courier office location, and an email address and contact phone number. Additional order notes may be provided if needed.
4. Discount Code Application: If available, enter a valid discount code in the designated field to apply any eligible discount to the order total before proceeding to payment.
5. Payment Method Selection: Choose a preferred payment method for the total amount, which may include Shop Pay, Google Pay, or debit/credit card payment, as the Merchant offers.
6. Agreement to Policies: Carefully review and actively accept the General Terms and Conditions and the Privacy Policy before finalizing the order request.
7. Order Submission: Complete the order by selecting the "Pay Now" button and submitting the order request to the Merchant for processing.
(3) the customer’s order request is considered a contractual offer upon submission. The merchant's acceptance of this offer, signaled by an email confirmation, finalizes the distance purchase contract.
Section IV - Steps for concluding a distance purchase contract
Art. 5 (1) Customers are entitled to enter into a remote purchase and sale contract for bags and accessories available on the online store. They can also order as guests (without requiring account registration).
(2) To initiate an order, Customers must complete the following steps:
1. Product Selection: Browse the selection of bags and accessories visible on the site, choosing one or more items by adding them to the shopping cart using the "Add to Cart" button.
2. Review and Confirmation: Review the cart's contents, including each product’s name, quantity, unit price, total amount, and any applicable shipping fees. Confirm the items by selecting the "Proceed to Checkout" button.3
3. Provision of Delivery Information: Enter all necessary delivery details, including the recipient’s full name, delivery address (street, city, postal code), or designated courier office location, as well as an email address and contact phone number. Additional order notes may be provided if needed.

7. Order Submission: Complete the order by selecting the "Place Order" button and submitting the order request to the Merchant for processing.
(3) States that the Customer’s order request is considered a contractual offer upon submission. The merchant's acceptance of this offer, signaled by an email confirmation, finalizes the distance purchase contract.
Art. 6 (1) The distance purchase contract between the Merchant and the Customer shall be deemed concluded upon receipt of the automatically generated confirmation message.
(2) By accepting these General Terms and Conditions, the Customer acknowledges that each item in an order may be subject to a separate distance purchase contract.
(3) The Merchant reserves the right to refuse orders in cases of unavailability, suspected misuse, or other circumstances without obligation to provide further details. In such cases, the Merchant will notify the Customer electronically within 24 hours of the order placement or by the end of the next business day.
Art. 7(1) All prices displayed in the online store are in euros and include value-added tax (VAT) and other applicable charges unless explicitly stated otherwise. Additional import taxes may apply for orders outside the USA, Hong Kong, or the EU, which are to be handled and paid by the Customer upon delivery. Orders to the UK are also subject to customs clearance, duties, and VAT; Customers are advised to consult the HMRC for details. The responsibility for clearing customs and paying import taxes rests solely with the Customer, and the Merchant holds no liability for customs procedures or associated fees.
(2) Customers may fulfill their payment obligations via one of the following methods:
- Debit or credit card (including MasterCard, Maestro, Visa, etc.)
- Shop Pay
- Google Pay
(3) All payments made to the Merchant will be processed in compliance with European legislation, and the Customer will receive an official receipt or invoice (either physical or electronic) for record purposes.
Art. 8 (1) In-stock orders are shipped within two business days from a warehouse in the USA, the Netherlands, or Hong Kong. During high-order periods, processing may take up to four business days. Warehouses operate during standard business hours, Monday through Friday, and are closed during national holidays in their respective countries. Due to unforeseen events such as customs delays, adverse weather, labor strikes, or high-volume peaks, the Merchant cannot guarantee exact delivery dates.
(2) For items sold as part of a promotional set, the discounted price applies only when the set is purchased. If the Customer wishes to return such promotional items, they must be returned together as a complete set for any refund to be issued.
Section V - User Roles. Rights and obligations of visitors, registered users, and customers
Art. 9 The online store offers three user roles, each with distinct rights and responsibilities based on their interaction level:
1. Visitor: An individual who views the online store without a registered account or order history.
2. Registered User: A user who has created and maintains an active account in the online store.
3. Customer: A user who has entered into a purchase agreement by ordering goods through the online store.
Art. 10 Visitors have the following rights:
1. Access the online store, browse bag selections, view product offers, and learn about the purchase terms.
2. To read blog posts, articles, and other informational content about bags, care tips, and industry trends published by the Merchant.
3. Contact the Merchant via designated communication channels for product inquiries or assistance using the online store.
4. To voluntarily provide personal data for registration purposes or inquiries through the contact form.
5. To report to the Merchant any potential infringement of intellectual property rights, including but not limited to images, descriptions, and branding elements.
6. To receive promotional information, news, and updates about the Merchant’s products, provided they consent to marketing communications.
7. To create an account for access to enhanced features and store functionalities.
8. To provide feedback or suggestions for improving the user experience or development of the online store.
Art. 11 Visitor Obligations:
1. To utilize the online store responsibly and in full compliance with applicable European Union (EU) or United States (USA) legislation and these Terms and Conditions.
2. To adhere to all regulations, directives, and rules governing online commerce within the European Union or USA.
3. To refrain from engaging in any activity that disrupts or compromises the store’s functionality or security.
4. Avoid unauthorized access to the Merchant’s servers, databases, or sensitive data.
5. Not to share confidential or proprietary information received from the Merchant without prior written consent.
6. To avoid duplicating, altering, or distributing store content unlawfully, including actions that infringe copyrights, without the Merchant’s express written permission.
7. Respect the Merchant’s rights and interests, and avoid actions or omissions that could cause harm or damage.
Art. 12 Registered Users have the following additional rights (alongside Visitor rights):
1. To place orders for bags and accessories, enter into a binding purchase contract through the online store.
2. To add items to a personalized “Favorites” list for future reference.
3. To submit reviews, ratings, or comments about purchased products based on personal experience.
4. To view their order history and track past transactions through their account.
5. To receive exclusive information on promotional offers, discounts, and member-only events available to Registered Users.
Art. 13 Registered User Obligations (in addition to Visitor obligations):
1. To provide accurate and up-to-date personal information in their account and promptly update any changes.
2. To safeguard their login credentials and not disclose account access details to third parties.
3. Adhere to the guidelines outlined in Section X when posting reviews, comments, or ratings to maintain a respectful and constructive environment.
Art. 14 Customers have the following additional rights (in addition to Visitor rights):
1. To receive status updates and delivery tracking information for ordered items.
2. To obtain proof of purchase, such as an invoice or receipt, verifying payment under the purchase contract.
3. According to USA and EU consumer protection laws, statutory rights, including the right to file a complaint or request a refund, must be exercised.
Art. 15 Customer Obligations (in addition to Visitor obligations):
1. Ensure they are available at the specified delivery address or visit the courier’s office on the scheduled delivery date to accept their order.
2. Inspect the goods upon receipt to verify that they match the product descriptions and specifications in the online store.
3. To immediately report any visible damages, defects, or discrepancies found upon delivery to the Merchant.
4. To pay for ordered items through the online payment options provided at checkout, including Shop Pay, Google Pay, or debit/credit cards, covering any delivery fees not borne by the Merchant.
5. Handle items carefully upon receipt to maintain their original packaging and commercial condition.
6. They should keep all correspondence about their orders and any issues confidential and only use it to resolve order-related queries or claims.
Section VI - Merchant's Rights and Obligations
Art. 16 Merchant’s Rights:
1. The Merchant may distribute promotional or marketing messages electronically (e.g., via email or SMS) to users or customers who have expressly opted to receive such communications.
2. The Merchant reserves the right to offer products and initiate distance purchase contracts to an unrestricted number of individuals.
3. The Merchant is entitled to receive payment for the goods placed in a customer's cart in advance when the customer selects an online payment method (such as credit or debit card, Shop Pay, or Google Pay). If alternative methods complete payment, payment must be received one business day before post-dispatch.
4. The Merchant may temporarily or permanently suspend or discontinue the availability of specific products due to stock limitations or other factors without prior notification, provided that it communicates such suspensions in a reasonable timeframe upon request.
5. The Merchant may decline order requests without specifying reasons, provided that notice is given to the interested party by the end of the next business day following the order request.
6. The Merchant has the right to securely collect, manage, and process the personal data of users and customers, subject to their explicit consent or if justified by legitimate business interests, in line with the Privacy Policy.
7. The Merchant may utilize customer reviews, ratings, and comments in promotional content, ensuring they are attributed accurately and respectfully.
8. All legal actions, including civil and criminal measures, are at the Merchant’s disposal to protect intellectual property, including product designs, images, and descriptions.
9. The Merchant may collaborate with third-party partners involved in managing, operating, and improving the online store, and the merchant holds full responsibility for their actions following the Privacy Policy.
10. To ensure smooth order fulfillment, the Merchant may use third-party logistics partners to deliver products to customers.
Art. 17 Merchant’s Obligations:
1. The Merchant shall maintain the online store in optimal technical condition, swiftly addressing and resolving any technical issues or operational disruptions, including third-party reports of bugs or other concerns.
2. The Merchant is committed to safeguarding users' and customers' rights and assisting in exercising those rights, including matters arising from distance purchase contracts and data protection obligations.
3. Upon completing the purchase process, the Merchant shall transfer ownership of the purchased items to the customer.
4. If an ordered item is unavailable, the Merchant shall inform the customer within 48 hours of receiving the order and offer alternative solutions if feasible.
5. The Merchant will promptly inform all affected individuals of any updates or modifications to the Terms and Conditions, Privacy Policy, shipping procedures, or other essential terms that may impact customer data or contract fulfillment.
6. The Merchant is liable under these General Terms and Conditions and applicable law, including covering any potential claims that arise directly from these terms or the distance purchase contract
Section VII - Delivery Terms
Art. 18 (1) The trader shall be responsible for arranging the delivery and handing over the goods(s) to the customer by using an external forwarder within 24 hours from the time of the order but no later than the first working day following the day of the email confirmation.
(2) All in-stock orders are usually fulfilled within 2-3 business days from our Netherlands warehouse. Please note that occasionally, our warehouse experiences periods of high order volume, and it can take up to 4 business days to fulfill your order. This is rare, however, and we do everything we can to ensure your order is shipped as quickly as possible.
(3) We are committed to ensuring the timely delivery of your orders. Our shipping options and estimated delivery times are as follows:
1. DPD CLASSIC Service—We offer the DPD CLASSIC service for deliveries within continental Europe. This service typically delivers orders within 2-6 business days. Please note that this is an estimated timeframe and may vary due to external factors.
2. UPS Express Saver - For orders to the United Kingdom, continental Europe, Africa, and the Middle East, we offer the UPS Express Saver® service. The estimated delivery window for this service is 2-4 business days. However, actual delivery times may vary based on location and unforeseen circumstances.
(4) We strive to meet these estimated delivery times; however, please note that delivery may be affected by customs processing, public holidays, promotional campaigns, or other logistical factors beyond our control.
(5) In the event of incorrect data required for the delivery, as well as in other cases in which, due to the volume or nature of the order or due to unforeseen circumstances, a more extended delivery period than that specified in the preceding subparagraphs is required, the Customer shall be promptly notified.
Art. 19 (1) If the Trader can deliver the product(s) subject to the distance purchase contract because they are unavailable, he must notify the customer within 24 hours of becoming aware of the lack of availability.
(2) If payment is made by card, the money shall be refunded within ten working days.
Art. 20 (1) The customer, or the third party, must inspect the goods before acceptance for apparent defects, shortages, or goods different from those ordered. The Customer shall immediately notify the Merchant if such a circumstance is found. If this is not possible, he should only accept the goods once he establishes contact with the Merchant by telephone or e-mail.
(2) If the actions referred to in the first sentence of the preceding paragraph are not carried out, the goods shall be approved, and the customer shall lose the right to claim later that the same were delivered with manifest defects or shortcomings. An exception to this rule shall only apply to products dispatched other than those requested in the order concerned.
Section VIII - Order Protection. Shipping Insurance add-ons.
Art. 21 (1) We offer order Protection as a shipping insurance add-on to enhance the safety and security of your purchase. This service protects your order if lost in transit, mistakenly delivered to an incorrect address, or stolen after delivery. By adding Order Protection to your purchase, you can receive a replacement order or a full refund of the purchase price should one of these issues arise.
(2) If you encounter any of the above issues after purchasing Order Protection, you may submit a claim directly to our insurance provider, Route or Order Protection. You’ll find the necessary contact information in the email confirmation when the insurance was initially applied to your order. Claims should be made directly to the insurance provider, as WANDRD does not handle replacements or refunds for orders covered by Order Protection.
(3) Order protection insurance is automatically calculated based on the total value of the order and the delivery address. This fee is usually a small percentage of the total purchase value but provides valuable peace of mind. The premium amount will be shown at checkout before you complete your order.
(4) Order Protection coverage is subject to the terms and conditions of the insurance provider, Route or Order Protection. Claims must comply with their procedures, and all related inquiries, including requests for refunds or replacements, must be directed to them directly.
Art. 22 (1) Adding Shipping Insurance is entirely optional and can be removed at any time by adjusting your cart settings under “View Your Cart” or simply deselecting it from your cart before checkout.
(2) Please be aware that without this coverage, we cannot be held liable for any incidents involving loss, theft, or misplacement of parcels by the carrier or after delivery. For added security, we encourage you to consider opting for Shipping Insurance to protect your order against these potential risks.
(3) When you select Order Protection at checkout, this coverage becomes part of your order and cannot be removed or refunded afterward. Upon completing your purchase, the insurance is confirmed with our provider, ensuring your order is covered against potential incidents during transit.
(4) Once your order is placed, additional items cannot be added. However, if your order has yet to be shipped, you may cancel it within one hour of purchase for a full refund. Following cancellation, you may create a new order and add Order Protection if desired.
Section IX - Conditions for return, refund, and exchange
Art. 23 (1) The trader is liable for any lack of conformity in the goods at the time of receiving them.
(2) The exercise of the right of complaint under par. One shall be exercised by completing and submitting the claim form
(3) Upon receipt of the completed form referred to in the preceding paragraph and after ascertaining the lack of conformity, the customer shall be entitled to receive goods that conform to the contract at the expense of the former.
(4) If the performance of the delivery of the goods subject to the distance purchase contract is not possible, the User has the right to a price reduction for partial performance or to cancel the contract by refunding the price paid for the goods through a bank account specified by him within 14 days of the request.
Art. 24 (1) Customers may return or exchange items purchased from our website within 30 days from the purchase date, except for the following non-returnable items: hats, face masks, mask filters, socks, crowdfunding pledges, and items marked as final sale.
(2) Customers must complete the online Return Form to initiate a return. After submission, a return slip will be provided via email. Customers are responsible for shipping the return to the address indicated on the return slip using an authorized carrier. Notification of the refund will be sent once processing is complete, which may take up to 15 days upon arrival at our warehouse.
(3) All returned items must be in new and unused condition, with original packaging and all tags attached in their original positions. Returns failing to meet these standards may be quarantined, and partial refunds may be issued at our discretion.
(4) Items without attached tags or otherwise returned in a policy violation are subject to at least a 20% restocking fee. Crowdfunding pledges are final sale items and are strictly non-returnable and non-exchangeable.
(5) We do not provide return shipping labels, allowing customers to select their preferred carrier. You must use a carrier offering tracking options, as we are not responsible for items lost in transit.
Art. 25 (1) Upon receipt of your returned package at our warehouse, each item will undergo scanning, inspection, and restocking. Customers will receive email notifications throughout this process; however, please allow up to 15 days from arrival for the refund to be issued.
(2) Due to inventory and accounting practices, partial returns of bundled items are not accepted. Customers wishing to return items from a bundle must return the entire set in new, unused condition with all tags attached and in its original packaging.
(3) Complimentary items or gifts included with your order do not need to be returned, even if the main items are being returned.
(4) Upon acceptance of the returned items, a refund in the form of a digital gift card will be issued. Within 24 hours, an email containing a gift card code for the refund amount will be sent, allowing customers to make future purchases. Be sure to check all email folders, including spam or junk, to ensure receipt of the notification.
Art. 26 (1) Upon arrival at our warehouse, returned items will be scanned, inspected, and restocked. Customers will receive email updates at each stage of this process. It may take up to 15 business days from receipt for a return to be fully processed.
(2) a refund will be issued to the original payment method once the return is accepted and processed. For most financial institutions, this refund should appear in the customer’s account within 3-7 business days. However, under certain circumstances, processing may take longer; if the refund is not visible within this timeframe, it will be processed no later than 14 days after the returned items' acceptance.
Section X - Intellectual Property Rights. User Generated Content.
Art. 27 (1) All content of the online store, including but not limited to the logo, graphic images, inscriptions, trademarks, dynamic symbols, texts, or other multimedia content, are the exclusive property of the Merchant unless otherwise agreed with the respective copyright holder.
(2) The trader retains all intellectual property rights relating in any way to the online shop, whether his own or obtained through contractual licenses or any other legal means. Any content accessed by individuals when visiting the online shop is subject to regulation by these terms and conditions.
(3) Any person shall be entitled to download, transfer, or use the content solely for personal non-commercial purposes, provided that such actions do not violate copyright and related rights under applicable USA law or do not violate the rules of these Terms and Conditions.
(4) The use of the content for commercial purposes is permissible only after obtaining written consent from the Merchant. Any subsequent or different use of the Content not agreed to and approved by the Merchant shall be deemed a breach of these Terms and Conditions, including a violation of the Merchant's intellectual property rights, who shall be entitled to hold the relevant person liable.
(5) In the presence of used content that contains a reference link to the Merchant's website or indicates its authorship right, it will not be considered consent.
(6) Any use of the Content for any purpose other than as expressly permitted in these Terms and Conditions or other express written consent given by the Merchant is prohibited.
Art. 28 (1) The trader shall give the consumers who have purchased goods through the trader the opportunity to send their opinions, comments, and evaluations of the purchased product(s). This generates customer-generated content.
(2) By submitting a review, comment, question, or answer, customers grant Merchant a non-exclusive, perpetual, irrevocable, and territorially unlimited license and the right to use, reproduce, adapt, publish, translate, distribute, and display such content.
Section XI - Protection of personal data
Art. 29. (1) The Merchant shall take measures to protect the personal data of the Visitor following Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals about the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR). The Merchant processes the personal data of the Visitors based on Art. 6 para. 1, б. "b" of the GDPR - the processing is necessary to perform a contract to which the customer is a party or based on Art. 6, para. 1, б. "a" of the GDPR - based on explicitly granted consent.
(2) The Merchant has made public the information concerning the personal data it processes and the purposes for which they are processed, ĸaĸ and all information required under Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals about the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) on the relevant page for this.
(3) The Merchant shall process third parties' personal data for dealership purposes only with their explicit consent, which they may withdraw at any time.
(4) Measures under the California Consumer Privacy Act, enacted in 2018 (CCPA), apply to data sharers who are U.S. citizens residing in the State of California
Section XII - Liability. Items warranty
Art. 30 (1) WANDRD will not be held responsible if an order cannot be processed or is declined due to unforeseen, objective circumstances. In such cases, WANDRD will inform the customer immediately.
(2) WANDRD disclaims liability for any direct or indirect damages incurred by customers or third parties from an inability to access or use the website, except in cases where WANDRD is proven solely responsible.
(3) The provision under paragraph (1) also applies to website content issues, including but not limited to errors or virus-related damages that could impact the customer’s device, data, or software as a result of browsing, downloading, or otherwise interacting with the website or any linked sites.
Art. 31 WANDRD disclaims liability for the content of any promotional materials, social media banners, or advertising displayed on third-party platforms, including potential inaccuracies, errors, or omissions.
Art. 32 WANDRD will be held liable for:
1. Violations of third-party copyrights in cases where proprietary content is developed and provided by WANDRD;
2. Failure to fulfill contract terms, specifically relating to product quality or quantity;
3. Any infringement upon third-party copyrights or related intellectual property rights;
4. Intentional or negligent violations of customer rights under applicable consumer protection laws.
Art. 33 (1) This warranty is provided exclusively to the original purchaser and applies only to products purchased directly from the seller or an authorized reseller.
(2) The warranty remains valid for the entire product lifespan, covering its functional performance as designed.
(3) This warranty does not cover Cosmetic imperfections from ordinary use or age-related wear.
Art. 34 (1) The warranty includes manufacturing defects affecting the product’s functional integrity when used for its intended purpose.
(2) Breakage or failures in product structure due to faults unrelated to misuse or general wear will be repaired or replaced.
(3) Items used beyond their intended function or suffered damage due to misuse are excluded from warranty coverage.
Art. 35 (1) The warranty claim process requires the original purchaser to complete the claim form, including relevant purchase information.
(2) Upon submission, the claim will be evaluated to determine eligibility, and the seller may offer to repair, replace, or provide other suitable remedies.
(3) All claims are addressed individually, and the seller commits to resolving valid claims satisfactorily.
Section XIII - Amendment and Supplement to the Terms and Conditions of Use.
Art. 36 (1) The Merchant may amend or supplement these General Terms and Conditions. The latter must notify all interested parties using the online store appropriately. The notification may be posted on the website's blog or social networks.
(2) The parties agree that any amendment or modification of these terms and conditions shall be effective as to them on whichever of the following events occurs first:
1. Upon notification by the Merchant, if the other party fails to state within the 14 days provided that it rejects or2
2. After publication in the online shop, if the other party does not state within 14 days of publication that it rejects them or
3. With the express acceptance of the other party by an action performed in the online store.
(3) All statements of the Merchant addressed to the other party in connection with the amendment of these General Terms and Conditions may also be sent to the e-mail address specified at the time of account registration or at the time of order.
Art. 37. These General Terms and Conditions and the existing legal relationship with the Merchant shall be terminated in the following cases:
- Upon termination and liquidation or bankruptcy of the Merchant;
- By mutual agreement of the parties in writing;
- In the event of the objective impossibility of either party to the contract to perform its obligations,
- In case of seizure, sealing of the equipment by state authorities or in case of imposition of a ban on commercial activity;
- Restricting or blocking an individual visitor's access to the website based on a breach of these Terms and Conditions;
- In other cases, they are expressly provided for by USA law.
Art. 38 The Merchant shall have the right to terminate the contract unilaterally at its discretion, without notice and compensation, if it finds that the other party is using the website in violation of these Terms and Conditions, the legislation in the United States, generally accepted moral standards or generally accepted rules in e-commerce.
Section XIV - Final provisions
Art. 39. (1) The present General Terms and Conditions regulate the legal relations between the Merchant and the Visitors, respectively, the Customers. American law shall apply unless otherwise expressly agreed upon between the parties.
(2) All disputes between the parties shall be resolved in a spirit of understanding and goodwill. If no agreement is reached, the court of competent jurisdiction shall resolve all unresolved disputes arising from or relating to the contract between the parties, including disputes arising from or relating to its interpretation, invalidity, performance, or termination.
Art. 40 (1) The parties to this Agreement undertake to protect each other's rights and legitimate interests, as well as to protect trade secrets and confidential information that have become known to them in the process of performance of the Contract and these General Terms and Conditions.
(2) The parties undertake not to make public any written or oral correspondence between them during and after the contract term. The publication of correspondence in print and electronic media, internet forums, private or public websites, etc., may be considered public knowledge.
Art. 41. In the event of a conflict between these General Terms and Conditions and the provisions of a particular contract between the Merchant and the other party, the provisions of the specific agreement shall prevail.
Art. 42. In the event of invalidity of any of the provisions of these Terms and Conditions, the parties agree that this shall not invalidate the entire contract.
Art. 43. (1) Neither party shall be liable for the non-performance of its contractual obligations under these General Terms and Conditions if such non-performance is due to force majeure. For a circumstance to be a force majeure event, the parties expressly agree that the following conditions must cumulatively exist:
- unpredictability of the event;
- extraordinary nature;
- the causal link between them and the impossibility of performance.
(2) If within 14 (fourteen) days from the date of occurrence of the relevant event, it is not terminated, either party shall be entitled to notify the other party that it is terminating the contract without owing the other any compensation for any damages that may have been suffered.
Art. 44. Each Visitor to the Website is informed of the possibility of recourse in the event of a dispute to a conciliation commission, mediation procedure, or other alternative dispute resolution.
